A jury for the second trial against Tony Scott Cercy has been selected in Wyoming’s Hot Springs County.
Cercy was found not-guilty on one count of First Degree Sexual Assault and one count of Second Degree Sexual Assault in February, 2018. The jury could not reach a unanimous verdict on a charge of Third Degree Sexual Assault.
It is that charge of Third Degree Sexual assault that Cercy faces in Hot Springs County.
The case was moved to the Hot Springs County District Court in June of 2018, after members of the Cercy defense team asked Natrona County District Court for a change-of-venue, citing media coverage of the events surrounding the February trial.
The alleged victim in the case claims that after a day of drinking with friends at the lake in June of 2017, she attended a party at the Cercy home near Alcova Reservoir, in Natrona County. The woman claims to have passed out at the party, awakening during the early morning hours of the following day to find Cercy performing oral sex on her.
Amended information in the case, allowed by the judge during an April 2018 hearing, is simplified from the original charge. Alleging unlawful sexual contact while the victim is physically helpless, and the actor knows or reasonably should know that the victim is physically helpless and that the victim has not consented.
The final jury, made up of 12 jurors and 2 alternates was sworn it at approximately 2:30 pm, and court was recessed for the holiday weekend before 3:00 pm.
The trial is expected to continue in Hot Springs County on Tuesday, November 13th, with opening statements.
District Attorney Michael Blonnigen is prosecuting the case. Cercy is represented by a legal team including Colorado attorneys Pamela Mackey and Jeff Pagliuca. Natrona County District Court Judge Daniel Forgey is presiding.
Cercy has denied the allegations against him.
